Rep. Ortitay introduces minimum gas royalty landowner protection bill

Since the natural gas extraction boom hit Pennsylvania, some landowners who lease their properties to gas companies for drilling purposes have become the target of bare minimum payments by those very gas companies legally bound to pay them their fair share of a royalty check.

State lawmakers have heard numerous examples of drilling companies drawing gas from leased properties then paying the mineral owners next to nothing after deducting their share of the costs of piping and processing the gas for market.

In an effort to increase fairness and transparency for landowners who receive natural gas royalties, state Rep. Jason Ortitay (R-Washington) has recently proposed legislation that would define what post-production costs are and what is considered to be an acceptable deduction.

Senate committee loads natural gas minimum royalty bills

For the third session in a row, Sen. Gene Yaw (R-Lycoming) has introduced a bill to give natural gas royalty owners additional tools to ensure they get paid the royalty payment owed to them and to further ensure that the payment occurs within a timely fashion.

 

Tuesday, that bill passed the committee he chairs—the Senate Environmental Resources and Energy Committee—by a unanimous vote.

Rep. Everett discusses natural gas minimum royalty legislation

Rep. Garth Everett (R-Lycoming) sat down with The PLS Reporter Tuesday afternoon to discuss House Bill 1391. 

If HB 1391 passes, then it would guarantee landowners 12.5 percent royalty on the natural gas extracted from their land. 

Rep. Everett stated that this bill,  "would affect thousands and thousands of landowners" in Pennsylvania’s gas- producing region.

Minimum royalty bills unanimously move through Senate

Despite new session, natural gas minimum royalty bills face same challenges

While the new session brings with it fresh attitudes, two bills that were couched as consumer protection bills for natural gas land landowners that were passed out of the Senate Environmental Resources and Energy Committee Wednesday are likely to face the same issues that caused them to stall last session.
